February 2, 2021: ARDC complaints can happen, but you might not know how to handle them. We have consulted with our ARDC counsel in order to create a guide on what to do if you were to receive an ARDC complaint. Follow or reference these easy steps in order to properly manage an ARDC complaint.
No one wants to get that letter that says that you are subject to an ARDC complaint. It happens; and, it is important to be prepared in the event it happens to you. At ISBA Mutual, we’ve created a guide to help you navigate an ARDC Complaint in the event you should receive one.
Details are as follows:
- Stay calm: know that the vast majority of matters are dismissed outright subsequent to the submission of an initial response.
- If you’re an ISBA Mutual insured, coverage is available to defend an ARDC disciplinary matter for costs and expenses expenses up to $25,000.
- Feel free contact us by filling out the form on our website, calling us at 1.866.473.4722, or email us at email@example.com.
- Don’t respond to these inquiries ‘pro se’: there can be too much emotion involved and an attorney can compound the manner by responding without consultation.
- Get an attorney! It doesn’t make you look “guilty” and the ARDC favors you getting an attorney.
- Stick to the facts: only answer the specific allegations lodged against you or your firm.
- If you don’t contact us, at the very least, ask a colleague to review your response, since whatever you say will make it back to the complainant.
- Provide all documents requested by the ARDC. The ARDC will ask for any additional materials.
- Finally: Be honest. Always cooperate.
